Hydrofy iOS Terms of Service

1. Use of the App

Hydrofy grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal use in connection with hydroponic tracking, logging, reminders, plant monitoring, and related features.

You may not:

• copy, distribute, sell, lease, sublicense, or commercially exploit the App except as allowed by law
• reverse engineer, decompile, or attempt to extract source code except where prohibited by law
• interfere with the App’s security, infrastructure, or access controls
• use the App in violation of any applicable law or regulation

2. No Account Required

Hydrofy may allow core use of the App without requiring account creation. You remain responsible for your device, your locally stored app data, and your use of the App.

3. User Content

You may choose to enter or submit content into the App, including:

• plant notes
• schedules
• reminders
• system details
• photos
• text prompts
• other materials you choose to provide

You are responsible for the content you submit and for ensuring you have any rights needed to provide that content.

4. AI Chat and Plant Scan

Hydrofy may provide AI-generated outputs, including plant scan results, possible diagnoses, suggestions, reminders, and related informational content.

These features are automated and provided for informational purposes only.

Hydrofy’s AI outputs may be wrong, incomplete, delayed, inconsistent, or unsuitable for your specific plant, crop, hydroponic system, nutrients, environment, or growing conditions.

5. No Professional, Agricultural, Food-Safety, or Treatment Advice

Hydrofy is not a professional horticultural, agronomic, engineering, pest-management, food-safety, laboratory, medical, or regulatory service.

Hydrofy does not guarantee that any scan, diagnosis, recommendation, or AI response will:

• correctly identify a plant problem
• correctly identify disease, pest, deficiency, toxicity, contamination, or spoilage
• provide safe or correct treatment steps
• prevent plant damage or crop loss
• improve plant health, growth, or yield
• determine whether edible plants, herbs, fruits, vegetables, or crops are safe to consume

You must use your own judgment and verify important decisions independently before acting on any output from the App.

6. Edible Plants and Consumption Decisions

Do not use Hydrofy as your only basis for deciding whether edible plants or produce are safe to harvest, consume, sell, or use.

AI-generated plant scan or diagnosis results may be inaccurate or incomplete. You are solely responsible for evaluating food safety, contamination risk, spoilage risk, and any harvesting or consumption decision.

7. Verify Before Acting

Before making any material change based on the App, including changes to:

• nutrients
• pH
• watering
• lighting
• pruning
• treatment steps
• sanitation or cleaning steps
• pest-control measures
• harvesting
• consumption decisions

you should independently verify the issue and the appropriateness of any action.

8. Use at Your Own Risk

Your use of Hydrofy, including plant scan and AI features, is at your own risk.

To the fullest extent permitted by law, Hydrofy and Merek Barrett disclaim liability for plant damage, crop loss, spoilage, contamination, equipment damage, lost profits, lost revenue, business interruption, or other losses arising out of or related to your reliance on the App or any AI-generated output.

9. No Warranties

The App is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Hydrofy disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

We do not warrant that the App will be uninterrupted, error-free, or free from harmful components, or that any output generated by the App will be accurate or suitable for your needs.

10. Limitation of Liability

To the fullest extent permitted by law, Hydrofy and Merek Barrett will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of crops, plants, harvests, produce, profits, revenue, goodwill, data, or equipment arising out of or related to your use of the App.

To the fullest extent permitted by law, Hydrofy’s total liability for any claim relating to the App will not exceed the greater of:

• the amount you paid, if any, for use of the App in the 12 months before the event giving rise to the claim, or
• CAD $100

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Acceptable Use

You may not use the App to:

• violate any law or regulation
• upload malicious code or harmful content
• abuse, attack, probe, or interfere with the App or its infrastructure
• infringe the rights of others
• use the App in a fraudulent, deceptive, or unlawful way

We may suspend or terminate access if we believe you are misusing the App.

12. Changes to the App

We may modify, suspend, or discontinue all or part of the App at any time, with or without notice, subject to applicable law.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and may provide additional notice where appropriate. Your continued use of the App after updated Terms become effective means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law rules.
